1、判决宣告以后，刑罚执行完毕以前，被判刑的犯罪分子又犯罪的，应当对新犯的罪作出判决，把前罪没有执行的刑罚和后罪所判处的刑罚决定执行的刑罚。
2、也就是说，首先应从前罪判决决定执行的刑罚中减去已经执行的刑罚，然后将前罪未执行的刑罚与后罪所判处的刑罚并罚，决定执行的刑罚。此种计算刑期的方法称为“先减后并。
